The operator of shemalepics.net is not the primary "producer" of any depictions of explicit sexual or simulated sexual behavior that may appear there. The operator of said website just engages in the activities of transmission, storage, retrieval, hosting, or formatting of content, which may depict explicit sexual behavior, that appears on the website because of actions taken by third-party users. The areas of shemalepics.net on which user-supplied content is presented are under the control of those users. Due to this fact, the operators and owners of shemalepics.net are exempt from compliance with Section 2257 records keeping and labeling obligations as expressed in 28 C.F.R. §75.1(c)(4).
